California Law

Hello,

Does anyone know what the laws are in California regarding the following:

If I am pulled over,
and my glove compartment is locked
and i do not consent to a search,
and there is nothing suspicious in plain sight or anything,
no Smells of ganja! nothing like that.

What can the cop do?
Does he obey the fact I do not want him looking in the glove compartment if all I was doing was speeding or something.

I really know nothing about this, can somebody fill me in?

I have no clue about the laws in California but I'd make sure before they nail you for possession. Good question to know if you intend to be carrying.............Infy

I would guess, and this is purely a guess, that if the cops don't have 'probable cause' they could not search without your consent.

The tricky part is figuring out what probable cause is
It may vary from individual to individual and from county to county (some are more or less strict than others).

Your best bet would be to check with your state statutes.

as long as your eyes look alright, you're not sluring your sentances, and there are no suspicious smells, you should be good.

Unless you get a total dick head of a cop that tries to scare you into confessing shit. Just don't give in. Question his powers as an authority figure. if you think he's out of line, ask for his badge number.

oh yeah, also, sherrifs can't search you ever. They gotta call for back-up from a real cop... and have them search you.

If there is nothing in glove compartment, then Let the officer look.
If you have something to hide, then say you don't give your consent...
Then the Cop/officer thinks he/she could have Probable Cause..
Cuz' they can Plant evidence if they don't like you
California Cops.?

Aren't they like C.H.I.P.S or something??

The truth? Coming from someone who's been pulled over plenty of times, and spent a night or two in a cell...

If the cop wants to search something, they can and will. They will figure out a loop hole later to make it okay. If they know the law well enough, they can do just about anything they want to.


Then again... maybe that's just Texas cops. Either way, I'd always stash it in the trunk, under the carpet, under the spare tire, in a first aid bag... Then, they'd really have to want it to find it.


Speaking purely rhetorically here, of course.
